General Terms and Conditions
1 § Scope of application
All services provided by nakedsteel GmbH are exclusively subject to the following General Terms and Conditions (GTC).
§ 2 Appointment, default and compensation

with the binding booking of an appointment in our online booking tool and our subsequent confirmation of the binding appointment by email, you contractually commit yourself to keep the appointment, while we contractually commit ourselves to keep your appointment free (appointment contract). By submitting the booking in our online booking portal, you also accept these terms and conditions as the basis of our appointment contract. You should allow at least one hour for your appointment, as delays can occur time and again.

if you can't keep the appointment agreed in the contract and don't cancel until one hour before the booked appointment or you are at least twenty minutes late, we will have a loss of earnings, so we have a claim against you for half of the price for the piercing you booked. The same applies if it turns out in the consultation or at a later time that compelling reasons for exclusion according to § 5 speak against the piercing. But we only have a claim against you for compensation for our loss of earnings if you are responsible for the missed appointment, the delay or the reason for exclusion (if you don't have a tetanus vaccination or you go on a beach holiday within the next four weeks for example).

you have the possibility to get a voucher of the same amount for the compensation paid for our loss of earnings, which is valid for 12 months from the date of issue. The return of a voucher is generally not possible, unless it was purchased online and is returned or sent back within the legal return period of two weeks.
§ 3 Conclusion of contract (piercing)

the piercing contract does not come about by booking the date, but with our (written) acceptance of the declaration of consent, but at the earliest with the fixing of performance and price (piercing contract). How does it come to the conclusion of the contract? First you book an appointment with us, primarily via our online booking tool. In this appointment we will have a counselling interview, in which you decide on the kind of piercing and if necessary on the piercing itself and you fill out the declaration of consent. In the course of the consultation you will also receive these terms and conditions, which you accept as basis of our appointment contract. If knowledge from the declaration of consent speaks against a piercing, we do not accept the declaration of consent. In the consequence no piercing contract will be concluded.

we reserve the right not to accept your declaration of consent and thus to renounce a piercing contract with you if we don't consider your experiences with piercings considering your age as sufficient (e.g. genital and nipple piercing under 18 years), if there is a reason for rejection according to § 5 or a reason for exclusion according to § 5.

additions and changes of the made agreements including these terms and conditions require text form to be effective.
§ 4 Prices, payment, vouchers

the prices stated in the consultation are final prices including the statutory value added tax.

the agreed price is due on the respective date after signing the declaration of consent and after the performance of our service. Payment by instalments is not permitted.

Our vouchers are valid for more than three years beyond the legal obligation. As long as the business is run by the current owner, they do not expire.
§ 5 Reasons for refusal and exclusion
If you are at least twenty minutes late to our appointment agreed in the appointment contract, we reserve the right to refuse the consultation and the conclusion of a piercing contract (reason for refusal).
In the following cases at least special conditions must be fulfilled for us to pierce you (reasons for exclusion). In our general conditions you will find useful explanations why we consider these prerequisites necessary. You are obliged to give truthful information about these requirements in the consultation and in the declaration of consent. Such prerequisites are the following:

from 7 and under 14, we only pierce earlobe piercings.

from 7-10 we do earlobe piercings only with a prior consultation. The piercing does NOT take place on the same day.
Both parents and the child must be present for the consultation. If there is only one person with parental authority, we require official proof (sole custody, proof of death, etc.). Both the parents and the child must be able to provide official identification (identity card, passport, child ID, etc.). A copy of the birth certificate must be brought to the counselling appointment. If there are any uncertainties here, please contact us. -
from the age of 11 you do not need counselling for earlobe piercings, both parents and the child must be present. If there is only one person with parental authority, we require official proof (sole custody, proof of death, etc.). Both the parents and the child must be able to provide official identification (identity card, passport, child IDÄ.). A copy of the birth certificate must be brought to the counselling appointment. If there are any uncertainties here, please contact us.

if you are over 14 and under 16 years old, we will only pierce you if you bring a parent or guardian to the appointment, who will give written consent on site. The other legal guardian has to fill out a document which can be downloaded on our homepage. If you only have a legal guardian, you must prove this to us. If you have more than one legal guardian, you do not have to bring all of them to the appointment, but only one. However, the written consent of all parents or guardians is required. All persons attending the appointment must be able to identify themselves with an official document. If you do not have the same last name as your parent or guardian, we will need other proof of parental authority, such as your birth certificate. We reserve the right to refuse piercings because of complicated healing (surface piercings, dermal anchor, bridge,..), risks, for reasons of maturity or sexual reasons with minors (genital and nipple piercings).

if you are over 16 years and under 18 years old, we pierce you only if you bring at least one legal guardian to the appointment, who agrees with the piercing. If you do not have the same last name as your parent or guardian, we will need other proof of parental authority, such as your birth certificate. We reserve the right to refuse piercings because of complicated healing (surface piercings, dermal anchor, bridge,..), risks, maturity reasons or sexual reasons with minors (genital piercings).

we do not pierce you if you want to take a flight in the next 48 hours after the piercing

for hygienic reasons, animals are not allowed in our shop (like in a hospital operating theatre). We will therefore not pierce you if you bring an animal to your appointment. We only make an exception if you need an assistance dog in the sense of § 12e paragraph 3 BBG (and prove this to us). In this case, however, piercing is only possible on the last appointment before the shop closes. Please let us know in advance that you are coming with an assistance dog so that we are prepared. You can either bring the documents with you to the appointment or send them to us in advance. Please understand that we cannot make an exception to the animal ban without the appropriate proof documents.

we do not pierce you if you want to travel to another climatic zone / bathing resort within four to six weeks after the piercing (depending on the piercing you are not allowed to go to the pool, lake or sea for four to eight weeks). Please note that most piercings have a healing time over several months, in which you can't wear a helmet for example (e.g. skiing holidays) and your piercing can still get inflamed (keyword: water quality, regular care). In these cases we would advise you against a piercing. If you are unsure if your piercing is useful at the moment, contact us!

we do not pierce you if you have taken antibiotics less than two weeks before the piercing.

we will not pierce you if you have been operated less than four weeks before the piercing or if you have to be operated planned four weeks after the piercing.

we will not pierce you if you have had an x-ray or MRI less than four weeks after piercing in the area.
-
we will not pierce you if you have a cold or feel bad immediately before the piercing.
-
if you are pregnant or breastfeeding or want to get pregnant, we will not pierce you.

if you suffer from a skin disease, a chronic, autoimmune or other disease, we advise you to contact us first to discuss how these can be problematic for the healing of your piercing. If we are unsure, we ask you to get a medical certificate of safety before we pierce you.

if you have taken any other medication that affects blood clotting or wound healing in the two days before the appointment, we will not pierce you.

if you have taken considerable amounts of alcohol or even only small amounts of (other) narcotics/drugs on the day before the piercing as well as on the day of the piercing, we will not pierce you. We also refuse to pierce if you have previously treated the area with an anaesthetic ointment, spray or similar.

if you are not vaccinated against tetanus, we will not pierce you. A tetanus vaccination is active for ten years.

if it turns out in the consultation or before/during the piercing that your anatomical conditions are in the way of the piercing, we won't pierce this piercing for you. For genital piercings, cartilage piercings in the ear (Rook, Industrial, Forward Helix, Daith), belly button piercings, Cheeks and Dahlias as well as surface piercings and Dermal Anchor we ask you for an alternative piercing at the booking or to come by for an anatomy check before.

We do not pierce both ears on the cartilage at the same time, as this can lead to considerable healing difficulties. Until an ear cartilage piercing has healed, we cannot proceed to the other side. We only want the best for you!

We ask you to inform yourself in the piercing section about the care, healing time and other details of your desired piercing so that you don't experience any surprises at your appointment.
As far as in the above mentioned reasons it is only stated that we advise you against the piercing, these are not compelling reasons for exclusion according to § 3 No. 3.
§ 6 Taking back, warranty, compensation

you should carefully consider which piercing jewellery you like, because we do not take back any piercing jewellery for reasons of hygiene, unless it was defective at purchase. If you order a piercing with us, for which you pay a deposit, you have to pick it up within three months from the time of our notification of readiness for pickup. Otherwise your order will be cancelled and the deposit minus our verifiable costs of the order process (e.g. shipping costs) will be refunded. If you have paid the deposit in cash, you must show up at our studio for the refund (also in cash).

your warranty claims are based on the general statutory provisions, unless otherwise specified below.

the limitation period for warranty claims is two years for new items. The preceding limitation periods do not apply to claims for damages due to injury to life, body, health, as well as claims for damages due to a violation of essential contractual obligations. Material contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract. Furthermore, the above limitation periods shall not apply to claims for damages based on an intentional or grossly negligent breach of duty by us or one of our vicarious agents.

a guarantee is not declared by us.

claims for damages are excluded, unless otherwise specified below. This also applies in favour of our vicarious agents, if you assert against these claims. Excluded from the exclusion of liability are claims for damages due to injury to life, body, health and claims for damages resulting from the violation of essential contractual obligations. Material contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract. Also excluded from the exclusion of liability is the liability for damages resulting from an intentional or grossly negligent breach of duty by us or one of our vicarious agents.
§ 7 Miscellaneous, final provisions

the place of performance for all obligations arising from the contractual relationship is our studio in Berlin, Mainzer Str. 10, 10247 Berlin, Germany, unless otherwise specified.

contractual relations with our customers are exclusively subject to German law.

the customer can only assign claims against us to third parties with our written consent.
